Responsible AI Use Policy

1. Purpose
1.1 Purpose
This Responsible Artificial Intelligence (“AI”) Use Policy (“Policy“) establishes the principles governing the responsible development, deployment, operation, and use of Artificial Intelligence (“AI”), Machine Learning (“ML”), Large Language Models (“LLMs”), automation technologies, and other intelligent systems provided, hosted, supported, or operated by Netwindy LLC (“Netwindy“, “Company“, “we“, “our“, or “us“).
Netwindy LLC is committed to promoting the responsible, ethical, secure, transparent, and lawful use of Artificial Intelligence while protecting the interests of Customers, employees, partners, and the public.
1.2 Objectives
The objectives of this Policy are to:
- Promote responsible and trustworthy use of Artificial Intelligence.
- Encourage human oversight of AI-assisted decisions.
- Protect customer information and intellectual property.
- Support lawful and ethical innovation.
- Reduce operational, cybersecurity, and privacy risks associated with AI technologies.
- Establish clear expectations for Customers and users of AI-enabled Services.
1.3 Guiding Principles
Netwindy LLC is committed to developing and operating Artificial Intelligence systems consistent with the following guiding principles:
- Human oversight and accountability.
- Transparency where reasonably practicable.
- Security by design.
- Privacy by design.
- Lawful and ethical use.
- Reliability and continuous improvement.
- Responsible innovation.
1.4 Human-Centered AI
Artificial Intelligence provided through Netwindy LLC’s Services is intended to assist human users by providing information, automation, analysis, recommendations, or other computational capabilities.
Artificial Intelligence is not intended to replace independent human judgment, professional expertise, legal advice, medical advice, financial advice, or other decisions requiring qualified human review.
1.5 Customer Responsibility
Customers remain solely responsible for all decisions, actions, communications, business processes, and operational activities that rely upon, incorporate, or are influenced by Artificial Intelligence generated content, recommendations, analyses, or automation.
The use of Artificial Intelligence does not transfer responsibility from the Customer to Netwindy LLC.
1.6 Relationship to Other Agreements
This Responsible Artificial Intelligence (AI) Use Policy is incorporated by reference into the applicable Master Services Agreement (MSA), Terms of Service (TOS), Acceptable Use Policy (AUP), Service Level Agreement (SLA), Privacy Policy, Statement of Work (SOW), Proposal, Quote, Service Order, and any other governing agreements applicable to the Services.
Violations of this Policy may constitute a material breach of one or more governing agreements.
1.7 Customer Acknowledgment
By purchasing, paying for, accessing, using, renewing, or continuing to use any Artificial Intelligence-enabled Service provided by Netwindy LLC, the Customer acknowledges that they have read, understand, and agree to comply with this Responsible Artificial Intelligence (AI) Use Policy together with all other governing agreements applicable to the Services.
2. Scope
2.1 Applicability
This Responsible Artificial Intelligence (AI) Use Policy applies to all Customers, authorized users, employees, contractors, consultants, temporary personnel, affiliates, resellers, partners, vendors, guests, and any other individual or entity accessing or utilizing Artificial Intelligence-enabled Services provided, hosted, operated, or supported by Netwindy LLC.
This Policy applies regardless of whether the Services are accessed directly or indirectly.
2.2 Covered Services
This Policy applies to all Artificial Intelligence, Machine Learning (“ML”), Large Language Model (“LLM”), automation, intelligent analytics, and AI-assisted technologies provided, hosted, integrated, managed, monitored, licensed, or otherwise supported by Netwindy LLC, including but not limited to:
- AI-powered virtual assistants.
- Conversational AI platforms.
- Knowledge management systems.
- Machine learning services.
- Predictive analytics.
- Threat detection and cybersecurity automation.
- Workflow automation.
- Generative AI services.
- Natural Language Processing (NLP).
- Computer vision technologies.
- Application Programming Interfaces (APIs).
- AI-enabled managed services.
- Future AI technologies offered by Netwindy LLC.
2.3 Covered Data
This Policy applies to all prompts, instructions, datasets, uploaded files, documents, images, audio recordings, video recordings, source code, software, databases, metadata, logs, training data, model outputs, and other information processed by AI-enabled Services.
2.4 Customer Responsibility
The Customer remains solely responsible for ensuring that all information submitted to AI-enabled Services is lawfully obtained, appropriately authorized, and may legally be processed using Artificial Intelligence technologies.
Customers shall not submit information that they are prohibited from disclosing under applicable law, contractual obligations, or regulatory requirements.
2.5 Third-Party AI Services
Netwindy LLC may integrate with or provide access to Artificial Intelligence services developed by third-party providers.
Use of third-party AI technologies may also be governed by the applicable terms, privacy policies, licensing agreements, and acceptable use requirements established by those providers.
2.6 Customer-Developed AI
This Policy also applies to Customer-developed Artificial Intelligence models, automations, agents, scripts, APIs, or other intelligent technologies hosted, operated, or managed using Netwindy LLC’s infrastructure or Services.
Customers remain solely responsible for the operation, outputs, compliance, and security of their AI systems.
2.7 Geographic Scope
This Policy applies worldwide to all Artificial Intelligence-enabled Services provided by Netwindy LLC, regardless of the Customer’s physical location or the jurisdiction from which the Services are accessed.
Customers remain responsible for complying with all applicable laws governing Artificial Intelligence, privacy, intellectual property, cybersecurity, and data protection within the jurisdictions in which they operate.
2.8 Survival
The obligations contained within this Policy shall survive suspension or termination of Services to the extent reasonably necessary to investigate misuse, preserve evidence, comply with legal obligations, protect intellectual property, defend legal claims, enforce contractual rights, or otherwise protect the rights of Netwindy LLC or third parties.
3. Guiding Principles
3.1 Human Oversight
Artificial Intelligence shall be used to assist, augment, and enhance human decision-making, not to replace appropriate human judgment. Customers and authorized users remain responsible for reviewing, validating, and approving significant decisions supported by AI-enabled Services.
Where professional judgment is required, qualified human review should be performed before relying upon AI-generated outputs.
3.2 Accountability
Customers remain solely responsible for all actions, decisions, communications, business processes, and operational activities performed using Artificial Intelligence-enabled Services.
The use of Artificial Intelligence does not transfer legal, contractual, regulatory, or operational responsibility from the Customer to Netwindy LLC.
3.3 Transparency
Netwindy LLC will use commercially reasonable efforts to provide Customers with information regarding the intended purpose and capabilities of AI-enabled Services where appropriate.
Customers should understand that Artificial Intelligence systems generate probabilistic outputs and may not always produce complete, accurate, or deterministic results.
3.4 Privacy by Design
Netwindy LLC is committed to designing, implementing, and operating AI-enabled Services with appropriate consideration for privacy, confidentiality, and responsible handling of Customer information.
Customers remain responsible for ensuring they possess the legal authority to submit information for AI processing.
3.5 Security by Design
Netwindy LLC endeavors to implement commercially reasonable administrative, technical, and physical safeguards designed to protect AI-enabled Services, underlying infrastructure, application programming interfaces (APIs), authentication mechanisms, models, datasets, and related systems from unauthorized access, misuse, or compromise.
3.6 Fair and Lawful Use
Artificial Intelligence shall be used only for lawful, ethical, and legitimate business purposes consistent with applicable laws, regulations, contractual obligations, and the governing agreements.
Customers shall not use AI-enabled Services to facilitate unlawful discrimination, fraud, deception, harassment, or other prohibited conduct.
3.7 Reliability and Continuous Improvement
Netwindy LLC is committed to continually improving the reliability, performance, security, and effectiveness of AI-enabled Services through ongoing monitoring, maintenance, updates, testing, and operational improvements.
Artificial Intelligence technologies evolve rapidly, and outputs may change as systems are updated or improved.
3.8 Ethical Innovation
Netwindy LLC supports the responsible advancement of Artificial Intelligence technologies that provide meaningful value to Customers while considering potential impacts on privacy, cybersecurity, intellectual property, human rights, and public trust.
3.9 Regulatory Compliance
Netwindy LLC endeavors to operate AI-enabled Services in a manner consistent with applicable laws and regulations. Customers remain responsible for ensuring that their own use of Artificial Intelligence complies with all laws, regulations, industry standards, contractual obligations, and internal governance requirements applicable to their business operations.
3.10 Reservation of Rights
Netwindy LLC reserves the right to modify, enhance, restrict, suspend, or discontinue Artificial Intelligence capabilities where reasonably necessary to improve security, reliability, legal compliance, operational stability, ethical operation, or protection of Customers, third parties, or Netwindy LLC’s infrastructure. Nothing contained in this Section limits Netwindy LLC’s rights under the Master Services Agreement (MSA), Terms of Service (TOS), Acceptable Use Policy (AUP), Privacy Policy, or applicable law.
4. Acceptable Use of Artificial Intelligence
4.1 Lawful Business Use
Artificial Intelligence-enabled Services provided by Netwindy LLC shall be used solely for lawful, ethical, and legitimate business, educational, research, administrative, or personal purposes consistent with applicable laws, regulations, contractual obligations, and the governing agreements.
4.2 Permitted Uses
Subject to the terms of this Policy and the applicable governing agreements, Customers may use AI-enabled Services for purposes including, but not limited to:
- Knowledge retrieval and information assistance.
- Content generation and editing.
- Business process automation.
- Software development assistance.
- Technical support and troubleshooting.
- Cybersecurity monitoring and threat analysis.
- Data analysis and reporting.
- Workflow optimization.
- Customer service automation.
- Research and educational activities.
4.3 Human Review
Customers should appropriately review AI-generated content before relying upon it for operational, legal, financial, medical, engineering, cybersecurity, or other significant business decisions.
Artificial Intelligence should be considered an assistive technology rather than a substitute for qualified professional judgment.
4.4 Responsible Automation
Customers may utilize AI-powered automation, scripting, intelligent agents, robotic process automation (RPA), application programming interfaces (APIs), and workflow automation provided such use does not unreasonably interfere with the availability, security, stability, or performance of Netwindy LLC’s Services.
4.5 Authorized Data
Customers shall submit only information that they are legally authorized to use with Artificial Intelligence-enabled Services.
Customers remain responsible for obtaining all necessary permissions, licenses, authorizations, and consents prior to processing information using AI technologies.
4.6 Intellectual Property
Customers shall respect all applicable intellectual property rights when using Artificial Intelligence-enabled Services, including copyrights, trademarks, patents, trade secrets, licensing agreements, and contractual restrictions.
Nothing contained in this Policy grants Customers rights to use protected intellectual property beyond those otherwise authorized by law or agreement.
4.7 Ethical Use
Customers shall use Artificial Intelligence in a manner that promotes honesty, fairness, transparency, respect for privacy, cybersecurity, and lawful business practices.
Customers shall not knowingly use AI-enabled Services to deceive individuals, manipulate information, facilitate fraud, or otherwise engage in unethical conduct.
4.8 Operational Responsibility
Customers remain solely responsible for all prompts submitted to AI systems, all information processed, all outputs generated, and all actions taken based upon AI-generated recommendations or automation.
Netwindy LLC does not assume responsibility for Customer decisions based upon AI-generated content.
4.9 Compliance with Governing Agreements
Use of Artificial Intelligence-enabled Services shall remain subject to the Master Services Agreement (MSA), Terms of Service (TOS), Acceptable Use Policy (AUP), Privacy Policy, Service Level Agreement (SLA), and all other applicable governing agreements.
4.10 Reservation of Rights
Netwindy LLC reserves the right to establish reasonable usage limitations, authentication requirements, operational safeguards, rate limits, technical controls, monitoring procedures, and other protective measures necessary to ensure the secure, reliable, ethical, and lawful operation of Artificial Intelligence-enabled Services. Nothing contained in this Section limits Netwindy LLC’s rights under the governing agreements or applicable law.
5. Prohibited Use of Artificial Intelligence
5.1 Unlawful Activities
Customers shall not use Artificial Intelligence-enabled Services to engage in, facilitate, promote, or assist any unlawful activity or any activity that violates applicable laws, regulations, contractual obligations, or the governing agreements.
5.2 Fraud and Deception
Artificial Intelligence shall not be used to create, facilitate, or support fraudulent, deceptive, misleading, or intentionally false communications, impersonation, identity theft, financial fraud, social engineering, or other malicious activities.
Customers remain solely responsible for all content generated or distributed using AI-enabled Services.
5.3 Malicious Cyber Activity
Customers shall not use AI-enabled Services to develop, distribute, automate, or facilitate:
- Malware or ransomware.
- Credential theft.
- Unauthorized access to systems or networks.
- Phishing campaigns.
- Denial-of-service attacks.
- Exploitation of software vulnerabilities.
- Circumvention of security controls.
- Other malicious cybersecurity activities.
5.4 Harmful Content
Customers shall not knowingly use Artificial Intelligence to generate, distribute, or promote content that is unlawful, defamatory, harassing, threatening, discriminatory, obscene, or otherwise prohibited under the applicable Terms of Service (TOS), Acceptable Use Policy (AUP), or applicable law.
5.5 Intellectual Property Violations
Artificial Intelligence-enabled Services shall not be used to knowingly infringe copyrights, trademarks, patents, trade secrets, licensing agreements, or other intellectual property rights.
Customers remain responsible for ensuring they possess all necessary rights before using copyrighted or proprietary materials with AI-enabled Services.
5.6 Privacy Violations
Customers shall not knowingly submit, collect, process, disclose, or generate information through AI-enabled Services in violation of applicable privacy laws, contractual confidentiality obligations, data protection regulations, or the rights of third parties.
5.7 High-Risk Decisions Without Human Review
Artificial Intelligence shall not be relied upon as the sole basis for decisions involving legal rights, employment, healthcare, financial approvals, public safety, cybersecurity response, or other high-risk matters without appropriate human review and oversight.
Customers remain responsible for ensuring qualified human judgment is exercised where appropriate.
5.8 Abuse of AI Systems
Customers shall not attempt to abuse, manipulate, disrupt, reverse engineer, circumvent technical safeguards, overload, or otherwise interfere with the normal operation, security, integrity, or availability of Netwindy LLC’s Artificial Intelligence systems or supporting infrastructure.
5.9 Circumvention of Safety Controls
Customers shall not knowingly attempt to bypass, disable, evade, or interfere with AI safety mechanisms, content filtering, access controls, rate limits, monitoring systems, or other technical safeguards implemented by Netwindy LLC or third-party AI providers.
5.10 Reservation of Rights
Netwindy LLC reserves the right to investigate suspected misuse of Artificial Intelligence-enabled Services, remove or restrict access to prohibited content, suspend or terminate Services, preserve relevant evidence, cooperate with Customers, governmental authorities, law enforcement agencies, and third-party providers, and pursue any contractual, equitable, or legal remedies available under the Master Services Agreement (MSA), Terms of Service (TOS), Acceptable Use Policy (AUP), this Policy, and applicable law.
6. Human Oversight
6.1 AI as an Assistive Technology
Artificial Intelligence-enabled Services provided by Netwindy LLC are intended to assist users by providing information, analysis, recommendations, automation, and other computational capabilities.
Artificial Intelligence is designed to augment human decision-making and shall not be considered a replacement for qualified human judgment, professional expertise, or independent decision-making.
6.2 Customer Responsibility
Customers remain solely responsible for reviewing, validating, approving, and acting upon any output generated by Artificial Intelligence-enabled Services.
The Customer assumes full responsibility for all decisions, communications, operational activities, and business processes that utilize or rely upon AI-generated information.
6.3 Professional Judgment
Artificial Intelligence should not be relied upon as the sole basis for legal, medical, financial, engineering, cybersecurity, regulatory, employment, public safety, or other professional decisions where qualified human expertise is reasonably required.
Customers are encouraged to consult appropriately qualified professionals before making decisions that may materially affect individuals, businesses, or legal rights.
6.4 Verification of AI Output
Customers should independently verify AI-generated information before relying upon it for operational, contractual, regulatory, financial, security, or other material purposes.
Artificial Intelligence outputs may contain inaccuracies, omissions, outdated information, or incomplete analysis.
6.5 Automated Decision-Making
Where Customers implement automated workflows, intelligent agents, robotic process automation (RPA), or other AI-driven processes, the Customer remains responsible for establishing appropriate review procedures, approval workflows, monitoring controls, exception handling, and operational safeguards.
6.6 Human Intervention
Customers should maintain reasonable procedures allowing qualified personnel to review, override, suspend, modify, or terminate AI-generated recommendations or automated actions whenever appropriate.
Artificial Intelligence should not operate without appropriate human governance where significant operational, legal, financial, privacy, or cybersecurity risks exist.
6.7 No Delegation of Responsibility
The use of Artificial Intelligence does not transfer legal, contractual, ethical, regulatory, or operational responsibility from the Customer to Netwindy LLC or to any Artificial Intelligence system.
Customers remain fully accountable for all activities conducted through AI-enabled Services.
6.8 Operational Controls
Netwindy LLC encourages Customers to implement internal governance procedures, approval processes, audit controls, employee training, documentation standards, and oversight mechanisms appropriate for their use of Artificial Intelligence.
6.9 No Warranty of Human Equivalence
Artificial Intelligence-enabled Services are not represented as possessing human reasoning, consciousness, professional licensure, legal authority, or independent decision-making capabilities.
Outputs generated by AI systems should be interpreted as computational assistance rather than authoritative conclusions.
6.10 Reservation of Rights
Netwindy LLC reserves the right to implement safeguards, approval requirements, monitoring capabilities, operational controls, technical limitations, or other protective measures designed to promote responsible human oversight of Artificial Intelligence-enabled Services. Nothing contained in this Section limits Netwindy LLC’s rights under the Master Services Agreement (MSA), Terms of Service (TOS), Acceptable Use Policy (AUP), Privacy Policy, this Policy, or applicable law.
7. AI Accuracy and Limitations
7.1 Nature of Artificial Intelligence
Artificial Intelligence-enabled Services generate probabilistic outputs based upon patterns identified within training data, algorithms, statistical models, and other computational processes. AI-generated responses are not guaranteed to be complete, accurate, current, or appropriate for every situation.
Artificial Intelligence should be viewed as an assistive technology rather than an authoritative source of truth.
7.2 No Guarantee of Accuracy
Netwindy LLC makes no representation or warranty that AI-generated outputs will be accurate, complete, reliable, current, error-free, or suitable for any particular purpose.
Customers should independently verify information before relying upon AI-generated outputs.
7.3 Hallucinations and Inaccuracies
Artificial Intelligence systems may generate inaccurate, incomplete, inconsistent, outdated, fabricated, or misleading information, sometimes referred to as “hallucinations.”
Customers acknowledge that such limitations are inherent to current Artificial Intelligence technologies and agree to exercise appropriate human judgment when evaluating AI-generated content.
7.4 Contextual Limitations
Artificial Intelligence may lack complete context regarding a Customer’s environment, contractual obligations, regulatory requirements, business objectives, or operational circumstances.
Outputs should therefore be evaluated in light of the Customer’s specific facts and circumstances.
7.5 No Professional Advice
Artificial Intelligence-enabled Services are not intended to provide legal, medical, financial, accounting, engineering, cybersecurity, tax, regulatory, or other professional advice.
Customers should consult appropriately qualified professionals before making decisions requiring specialized expertise.
7.6 Customer Verification
Customers remain solely responsible for reviewing, validating, testing, approving, and implementing any AI-generated recommendations, code, analyses, documentation, automation, or other outputs before use in production environments or business operations.
7.7 Continuous Evolution
Artificial Intelligence technologies, underlying models, training methodologies, datasets, and system capabilities may evolve over time.
Accordingly, responses generated by AI-enabled Services may vary over time, even when presented with similar prompts or inputs.
7.8 Operational Limitations
Artificial Intelligence-enabled Services may be affected by software defects, incomplete information, third-party dependencies, infrastructure limitations, network interruptions, model updates, service outages, security events, or other operational conditions that may influence system behavior or output quality.
7.9 No Warranty
Except as expressly provided in the applicable Master Services Agreement (MSA) or Service Level Agreement (SLA), Artificial Intelligence-enabled Services are provided on an “as available” and “as provided” basis. Netwindy LLC expressly disclaims any warranty that AI-generated outputs will satisfy the Customer’s expectations or intended purposes.
7.10 Reservation of Rights
Netwindy LLC reserves the right to modify, retrain, replace, suspend, update, restrict, or discontinue Artificial Intelligence models, algorithms, datasets, integrations, features, or capabilities as reasonably necessary to improve accuracy, security, legal compliance, operational stability, or service quality. Nothing contained in this Section limits Netwindy LLC’s rights under the Master Services Agreement (MSA), Terms of Service (TOS), Acceptable Use Policy (AUP), Privacy Policy, this Policy, or applicable law.
8. Privacy and Data Protection
8.1 Protection of Customer Information
Netwindy LLC is committed to protecting the confidentiality, integrity, and availability of Customer information processed through Artificial Intelligence-enabled Services using commercially reasonable administrative, technical, and physical safeguards appropriate to the Services provided.
Nothing contained in this Policy expands Netwindy LLC’s obligations beyond those expressly provided in the applicable governing agreements.
8.2 Customer Responsibility for Submitted Data
Customers remain solely responsible for all prompts, documents, files, source code, databases, images, audio recordings, video recordings, datasets, and other information submitted to Artificial Intelligence-enabled Services.
Customers represent that they possess all necessary rights, permissions, authorizations, and legal authority to process such information using Artificial Intelligence technologies.
8.3 Sensitive Information
Customers should exercise appropriate care before submitting confidential, proprietary, regulated, or sensitive information to AI-enabled Services.
Unless expressly authorized under a separate written agreement, Customers should avoid submitting information that they are prohibited from disclosing under applicable law, contractual obligations, or regulatory requirements.
8.4 Data Processing
Information submitted to Artificial Intelligence-enabled Services may be processed for the purpose of generating requested outputs, maintaining system functionality, improving operational reliability, enhancing security, troubleshooting technical issues, and performing other activities reasonably necessary to provide the Services.
Processing activities shall be conducted in accordance with the applicable governing agreements and Netwindy LLC’s Privacy Policy.
8.5 Logging and Audit Records
Netwindy LLC may maintain system logs, operational metrics, authentication records, audit trails, usage statistics, security events, prompts, responses, and other technical records reasonably necessary for security, operational support, service improvement, legal compliance, billing, fraud prevention, and incident response.
Retention of such records shall be governed by applicable law, contractual obligations, and Netwindy LLC’s record retention practices.
8.6 Third-Party AI Providers
Where Artificial Intelligence-enabled Services utilize third-party models, application programming interfaces (APIs), cloud platforms, or other external providers, Customer information may be processed in accordance with the applicable contractual agreements, privacy policies, and legal obligations governing those providers.
Netwindy LLC will use commercially reasonable efforts to engage reputable providers appropriate for the Services offered.
8.7 Data Security
Netwindy LLC endeavors to implement commercially reasonable safeguards designed to protect AI-enabled Services against unauthorized access, disclosure, alteration, destruction, misuse, or loss of Customer information.
No security system can guarantee absolute protection against every cybersecurity threat or unauthorized disclosure.
8.8 Customer Privacy Obligations
Customers remain responsible for complying with all applicable privacy, data protection, confidentiality, cybersecurity, export control, and information governance laws applicable to their use of Artificial Intelligence-enabled Services, including obtaining any required notices or consents from affected individuals.
8.9 Privacy Policy
The collection, use, storage, disclosure, retention, and protection of personal information by Netwindy LLC shall also be governed by the Company’s Privacy Policy and any applicable Data Processing Agreement (DPA) or other written agreement executed between the parties.
8.10 Reservation of Rights
Netwindy LLC reserves the right to implement additional privacy safeguards, security controls, logging requirements, retention policies, monitoring capabilities, technical restrictions, or operational procedures reasonably necessary to protect Customer information, comply with applicable law, maintain the security of Artificial Intelligence-enabled Services, and fulfill its contractual and regulatory obligations. Nothing contained in this Section limits Netwindy LLC’s rights under the Master Services Agreement (MSA), Terms of Service (TOS), Privacy Policy, Data Processing Agreement (DPA), this Policy, or applicable law.
9. Security of Artificial Intelligence Systems
9.1 Security Commitment
Netwindy LLC is committed to implementing commercially reasonable administrative, technical, and physical safeguards designed to protect Artificial Intelligence-enabled Services, supporting infrastructure, application programming interfaces (APIs), models, datasets, and related systems from unauthorized access, misuse, alteration, disclosure, disruption, or destruction.
9.2 Customer Security Responsibilities
Customers remain solely responsible for maintaining the security of their own accounts, authentication credentials, devices, applications, networks, prompts, datasets, and environments that interact with Artificial Intelligence-enabled Services.
Customers should implement appropriate security controls, including strong authentication, access management, endpoint protection, and regular security monitoring.
9.3 Access Controls
Access to Artificial Intelligence-enabled Services should be limited to authorized users with a legitimate business need.
Customers are responsible for managing user accounts, permissions, role-based access controls, and the timely removal of unnecessary or unauthorized access.
9.4 Protection Against Abuse
Netwindy LLC may implement technical safeguards designed to detect and mitigate unauthorized access attempts, abusive behavior, excessive resource consumption, malicious automation, prompt injection attacks, credential abuse, API misuse, and other activities that may threaten the security or availability of AI-enabled Services.
9.5 Prompt Injection and Model Manipulation
Customers shall not knowingly attempt to manipulate, exploit, bypass, corrupt, poison, reverse engineer, or otherwise interfere with Artificial Intelligence models, prompts, guardrails, safety mechanisms, retrieval systems, training processes, or supporting infrastructure.
Any attempt to compromise the integrity or intended operation of AI-enabled Services may result in immediate enforcement actions.
9.6 Incident Reporting
Customers should promptly notify Netwindy LLC of any suspected compromise, unauthorized access, security vulnerability, misuse, or other security incident involving Artificial Intelligence-enabled Services.
Timely reporting assists Netwindy LLC in protecting Customers and maintaining the integrity of the Services.
9.7 Security Monitoring
Netwindy LLC may utilize monitoring systems, logging, analytics, anomaly detection, rate limiting, authentication controls, audit records, and other security technologies reasonably necessary to protect Artificial Intelligence-enabled Services and supporting infrastructure.
Such monitoring shall be conducted in accordance with applicable law and Netwindy LLC’s Privacy Policy.
9.8 Security Updates
Netwindy LLC reserves the right to deploy software updates, security patches, model improvements, infrastructure enhancements, configuration changes, and other operational modifications reasonably necessary to maintain the security, stability, reliability, and compliance of Artificial Intelligence-enabled Services.
9.9 Shared Responsibility
Security is a shared responsibility between Netwindy LLC and its Customers. While Netwindy LLC endeavors to maintain secure AI-enabled Services, Customers remain responsible for securely configuring, managing, and using the Services within their own operational environments.
9.10 Reservation of Rights
Netwindy LLC reserves the right to implement additional security controls, monitoring capabilities, authentication requirements, access restrictions, rate limits, operational safeguards, incident response measures, or temporary service restrictions reasonably necessary to protect Artificial Intelligence-enabled Services, Customers, third parties, or Netwindy LLC’s infrastructure. Nothing contained in this Section limits Netwindy LLC’s rights under the Master Services Agreement (MSA), Terms of Service (TOS), Acceptable Use Policy (AUP), Privacy Policy, this Policy, or applicable law.
10. Intellectual Property
10.1 Ownership of Customer Content
Except as otherwise expressly provided in a written agreement, Customers retain all ownership rights, title, and interest in the prompts, documents, source code, datasets, images, audio recordings, video recordings, software, databases, and other information submitted to Artificial Intelligence-enabled Services.
Nothing contained in this Policy transfers ownership of Customer intellectual property to Netwindy LLC.
10.2 AI-Generated Content
Ownership, licensing, and permitted use of AI-generated content may depend upon applicable law, the capabilities of the underlying Artificial Intelligence technology, and any applicable agreements governing the Services.
Customers are solely responsible for determining whether AI-generated outputs are appropriate for their intended use and whether additional intellectual property protections are necessary.
10.3 Customer Responsibility
Customers remain solely responsible for reviewing AI-generated content before publication, distribution, commercialization, or other use to ensure that such content does not knowingly infringe the copyrights, trademarks, patents, trade secrets, publicity rights, or other intellectual property rights of third parties.
10.4 Third-Party Intellectual Property
Customers shall not knowingly use Artificial Intelligence-enabled Services to reproduce, distribute, modify, reverse engineer, misappropriate, or otherwise infringe the intellectual property rights of any third party.
Customers are responsible for obtaining all necessary licenses, permissions, and authorizations before using protected works with AI-enabled Services.
10.5 Training Data
Unless expressly agreed in writing, Customer information submitted to Artificial Intelligence-enabled Services shall not be used by Netwindy LLC to train proprietary Artificial Intelligence models beyond the scope necessary to provide the requested Services and perform activities otherwise authorized under the applicable governing agreements and Privacy Policy.
10.6 Open Source and Third-Party Models
Artificial Intelligence-enabled Services may incorporate open-source software, publicly available models, commercial models, third-party datasets, or other licensed technologies.
Customers remain responsible for complying with all applicable licensing terms governing their use of such technologies where required.
10.7 Confidential and Proprietary Information
Customers shall not knowingly submit confidential, proprietary, trade secret, export-controlled, or otherwise restricted information to Artificial Intelligence-enabled Services unless such processing is expressly authorized under the applicable Service Agreement and governing agreements.
10.8 Netwindy Intellectual Property
All rights, title, and interest in Netwindy LLC’s Artificial Intelligence platforms, software, algorithms, workflows, integrations, APIs, documentation, trademarks, service marks, logos, proprietary methodologies, and other intellectual property remain the exclusive property of Netwindy LLC or its licensors.
Nothing contained in this Policy grants Customers any ownership interest in Netwindy LLC’s intellectual property except for the limited rights expressly granted under the applicable Service Agreement.
10.9 Infringement Claims
Customers who believe that copyrighted works or other intellectual property rights have been infringed through the use of Artificial Intelligence-enabled Services should submit a report in accordance with Netwindy LLC’s Copyright Infringement and DMCA Policy.
10.10 Reservation of Rights
Netwindy LLC reserves all intellectual property rights not expressly granted under the applicable governing agreements. Netwindy LLC further reserves the right to protect its intellectual property, cooperate with copyright owners and governmental authorities, investigate alleged infringement, preserve relevant evidence, remove infringing content where appropriate, and pursue any contractual, equitable, statutory, or legal remedies available under the Master Services Agreement (MSA), Terms of Service (TOS), Copyright Infringement and DMCA Policy, this Policy, and applicable law.
11. Regulatory Compliance
11.1 Compliance with Applicable Laws
Customers shall use Artificial Intelligence-enabled Services in compliance with all applicable international, federal, state, provincial, and local laws, regulations, court orders, industry standards, and governmental requirements governing their activities.
Netwindy LLC endeavors to operate its Artificial Intelligence-enabled Services in accordance with applicable legal and regulatory requirements governing the Services provided.
11.2 Customer Responsibility
Customers remain solely responsible for determining whether their use of Artificial Intelligence-enabled Services complies with laws, regulations, contractual obligations, licensing requirements, and industry-specific standards applicable to their business operations.
The use of Artificial Intelligence does not relieve Customers of their legal or regulatory obligations.
11.3 Industry Regulations
Depending upon the Customer’s business activities, applicable regulations may include, but are not limited to:
- Healthcare privacy regulations.
- Financial services regulations.
- Data protection and privacy laws.
- Export control regulations.
- Consumer protection laws.
- Employment laws.
- Cybersecurity regulations.
- Industry-specific compliance requirements.
Customers remain solely responsible for ensuring compliance with all regulations applicable to their organization.
11.4 Privacy and Data Protection
Customers shall ensure that all personal information, confidential information, regulated data, and sensitive information submitted to Artificial Intelligence-enabled Services is processed in accordance with applicable privacy laws, contractual obligations, and organizational policies.
Where legally required, Customers are responsible for obtaining all necessary notices, authorizations, and consents.
11.5 Export Controls and Sanctions
Customers shall not use Artificial Intelligence-enabled Services in violation of applicable export control laws, trade sanctions, embargoes, or other international trade restrictions.
Customers remain responsible for ensuring that their use of AI-enabled Services complies with all applicable import, export, and sanctions regulations.
11.6 Artificial Intelligence Regulations
As Artificial Intelligence laws and regulations continue to evolve, Customers remain responsible for ensuring that their implementation and use of AI-enabled Services comply with applicable Artificial Intelligence governance requirements within the jurisdictions in which they operate.
Netwindy LLC may modify its Services or operational practices as reasonably necessary to comply with evolving legal requirements.
11.7 Audits and Investigations
Where required by applicable law or contractual obligation, Customers agree to reasonably cooperate with investigations relating to the use of Artificial Intelligence-enabled Services, including providing information reasonably necessary to evaluate compliance with applicable legal or regulatory requirements.
11.8 No Legal Advice
Netwindy LLC does not provide legal, regulatory, compliance, accounting, or professional advisory services through its Artificial Intelligence-enabled Services.
Customers should consult qualified legal or regulatory professionals regarding their specific compliance obligations.
11.9 Regulatory Changes
Artificial Intelligence regulations continue to evolve globally. Netwindy LLC reserves the right to modify Artificial Intelligence-enabled Services, operational controls, documentation, technical safeguards, or customer requirements as reasonably necessary to comply with changes in applicable law or regulatory guidance.
11.10 Reservation of Rights
Netwindy LLC reserves the right to implement compliance controls, operational safeguards, monitoring procedures, documentation requirements, access restrictions, reporting mechanisms, or other reasonable measures necessary to comply with applicable laws, regulations, governmental directives, contractual obligations, and industry standards. Nothing contained in this Section limits Netwindy LLC’s rights under the Master Services Agreement (MSA), Terms of Service (TOS), Acceptable Use Policy (AUP), Privacy Policy, this Policy, or applicable law.
12. Monitoring and Abuse Prevention
12.1 Operational Monitoring
Netwindy LLC may utilize commercially reasonable monitoring technologies to maintain the security, availability, reliability, integrity, performance, and lawful operation of Artificial Intelligence-enabled Services.
Monitoring activities may include system health, authentication events, API usage, operational metrics, audit logs, anomaly detection, and security events.
12.2 Abuse Detection
Netwindy LLC reserves the right to monitor for activities that may threaten the integrity, security, availability, or lawful operation of Artificial Intelligence-enabled Services, including but not limited to:
- Unauthorized access attempts.
- Prompt injection attacks.
- Credential abuse.
- API abuse.
- Excessive automated requests.
- Resource exhaustion.
- Malicious automation.
- Attempts to bypass safety controls.
- Activities prohibited by this Policy.
12.3 Rate Limiting and Technical Controls
Netwindy LLC may implement reasonable rate limits, authentication requirements, quotas, content filtering, session controls, API restrictions, request validation, and other technical safeguards designed to ensure fair, secure, and reliable access to Artificial Intelligence-enabled Services.
Customers shall not attempt to circumvent such controls.
12.4 Investigations
Where Netwindy LLC reasonably suspects misuse, abuse, fraud, security threats, or violations of this Policy, the Company may investigate the matter using commercially reasonable procedures, including the review of operational logs, audit records, technical telemetry, customer communications, and other relevant information.
12.5 Enforcement Actions
Where Netwindy LLC reasonably determines that misuse or abuse has occurred, the Company may take appropriate corrective action, including issuing warnings, requiring corrective measures, limiting functionality, suspending access, removing content, disabling automation, restricting APIs, or terminating Services in accordance with the governing agreements.
12.6 Preservation of Evidence
Netwindy LLC may preserve system logs, prompts, responses, audit records, authentication events, security alerts, technical evidence, communications, and other operational information reasonably necessary to investigate misuse, comply with legal obligations, support incident response, or defend legal claims.
12.7 Customer Cooperation
Customers agree to reasonably cooperate with investigations involving suspected misuse of Artificial Intelligence-enabled Services, including providing information reasonably necessary to evaluate security events, abuse reports, compliance concerns, or operational incidents.
12.8 Privacy Considerations
Monitoring activities shall be conducted in accordance with applicable law, Netwindy LLC’s Privacy Policy, applicable Data Processing Agreements (DPAs), and other governing agreements.
Nothing contained in this Section authorizes monitoring beyond what is reasonably necessary to provide, secure, maintain, or protect the Services.
12.9 No Obligation to Detect Every Incident
Although Netwindy LLC endeavors to implement commercially reasonable monitoring and abuse detection capabilities, no monitoring system can detect every misuse, security event, policy violation, or malicious activity.
Customers remain responsible for appropriately monitoring and securing their own environments and reporting suspected incidents.
12.10 Reservation of Rights
Netwindy LLC reserves the right to implement additional monitoring technologies, abuse prevention mechanisms, authentication requirements, security controls, operational safeguards, temporary restrictions, or enforcement actions reasonably necessary to protect Artificial Intelligence-enabled Services, Customers, third parties, and Netwindy LLC’s infrastructure. Nothing contained in this Section limits Netwindy LLC’s rights under the Master Services Agreement (MSA), Terms of Service (TOS), Acceptable Use Policy (AUP), Privacy Policy, this Policy, or applicable law.
13. Limitation of Liability
13.1 AI is an Assistive Technology
Artificial Intelligence-enabled Services provided by Netwindy LLC are intended solely as assistive technologies designed to support human productivity, automation, information retrieval, analysis, and decision-making.
Artificial Intelligence does not replace qualified human judgment, professional expertise, or independent decision-making.
13.2 No Warranty of Results
Except as expressly provided in the applicable Master Services Agreement (MSA) or Service Level Agreement (SLA), Artificial Intelligence-enabled Services are provided on an “as available” and “as provided” basis without any representation or warranty regarding accuracy, completeness, reliability, fitness for a particular purpose, or uninterrupted operation.
Netwindy LLC expressly disclaims any warranty that AI-generated outputs will satisfy the Customer’s specific objectives or expectations.
13.3 Customer Responsibility
Customers remain solely responsible for reviewing, validating, testing, approving, implementing, and relying upon all Artificial Intelligence-generated outputs, recommendations, analyses, code, documentation, automations, workflows, or other information generated through AI-enabled Services.
The Customer assumes all responsibility for decisions and actions taken based upon AI-generated content.
13.4 No Professional Advice
Artificial Intelligence-enabled Services are not intended to provide legal, medical, financial, accounting, engineering, cybersecurity, tax, regulatory, investment, or other professional advice.
Customers should consult appropriately qualified professionals before relying upon Artificial Intelligence for matters requiring specialized expertise.
13.5 No Liability for Customer Decisions
Netwindy LLC shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or other damages arising from or relating to Customer reliance upon Artificial Intelligence-generated content, recommendations, analyses, automation, or decisions.
The Customer remains solely responsible for evaluating the appropriateness of AI-generated outputs.
13.6 Third-Party Technologies
Artificial Intelligence-enabled Services may incorporate third-party software, cloud platforms, APIs, datasets, language models, open-source technologies, or other external components.
Netwindy LLC shall not be responsible for the performance, availability, accuracy, security, or functionality of third-party technologies beyond the obligations expressly assumed under the applicable governing agreements.
13.7 Customer Indemnification
To the fullest extent permitted by applicable law and the governing agreements, Customers agree to defend, indemnify, and hold harmless Netwindy LLC from claims, damages, liabilities, losses, costs, and expenses arising from the Customer’s use or misuse of Artificial Intelligence-enabled Services, including claims involving unlawful content, intellectual property infringement, privacy violations, regulatory non-compliance, or other violations of applicable law.
13.8 Limitation of Remedies
Nothing contained in this Policy expands Netwindy LLC’s liability beyond that expressly provided in the applicable Master Services Agreement (MSA), Terms of Service (TOS), Service Level Agreement (SLA), Acceptable Use Policy (AUP), Privacy Policy, or applicable law.
All contractual limitations of liability contained within the governing agreements remain fully applicable to Artificial Intelligence-enabled Services.
13.9 Survival
The limitations of liability, disclaimers, indemnification obligations, preservation of evidence, intellectual property protections, confidentiality obligations, accrued rights, and legal remedies contained within this Policy shall survive suspension or termination of the applicable Services to the maximum extent permitted by applicable law.
13.10 Reservation of Rights
Netwindy LLC reserves all contractual, equitable, statutory, and legal rights available under the Master Services Agreement (MSA), Terms of Service (TOS), Acceptable Use Policy (AUP), Privacy Policy, Service Level Agreement (SLA), this Responsible Artificial Intelligence (AI) Use Policy, and applicable law. Nothing contained herein shall be interpreted as creating any warranty, guarantee, fiduciary duty, or additional legal obligation not expressly assumed by Netwindy LLC.
14. Revisions to this Responsible Artificial Intelligence (AI) Use Policy
14.1 Right to Modify
Netwindy LLC reserves the right to revise, amend, modify, supplement, or replace this Responsible Artificial Intelligence (AI) Use Policy (“Policy”) at any time to reflect changes in applicable law, technology, industry standards, Artificial Intelligence capabilities, cybersecurity risks, regulatory requirements, business operations, or the Services provided by Netwindy LLC.
14.2 Notice of Changes
Updated versions of this Policy will be published through the Netwindy LLC website, Customer Portal, Billing Portal, or other commercially reasonable communication methods.
The most current version shall supersede all prior versions as of its published effective date unless otherwise expressly stated.
14.3 Continued Use
The Customer’s continued purchase, renewal, payment for, access to, or use of any Artificial Intelligence-enabled Service following the effective date of a revised Policy constitutes acceptance of the revised terms to the extent permitted by applicable law.
14.4 Relationship to Other Agreements
This Responsible Artificial Intelligence (AI) Use Policy shall be read together with the applicable Master Services Agreement (MSA), Terms of Service (TOS), Acceptable Use Policy (AUP), Service Level Agreement (SLA), Privacy Policy, Data Processing Agreement (DPA), Statement of Work (SOW), Proposal, Quote, Service Order, and any other governing agreements applicable to the Services.
In the event of a conflict between this Policy and the Master Services Agreement (MSA), the Master Services Agreement shall control unless otherwise expressly provided in writing.
14.5 No Waiver
The failure of Netwindy LLC to enforce any provision of this Policy shall not constitute a waiver of that provision or any other provision.
No waiver shall be effective unless made in writing by an authorized representative of Netwindy LLC.
14.6 Severability
If any provision of this Policy is determined to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
The invalid provision shall be interpreted or modified only to the extent necessary to preserve the original intent of the parties while complying with applicable law.
14.7 Survival
Any provisions of this Policy that by their nature should survive the expiration or termination of the applicable Service Agreement, including confidentiality obligations, intellectual property protections, limitations of liability, investigations, preservation of evidence, security obligations, indemnification provisions, accrued rights, and legal remedies, shall survive such expiration or termination.
14.8 Entire Policy
This Responsible Artificial Intelligence (AI) Use Policy constitutes the complete statement of Netwindy LLC’s policies governing the responsible development, deployment, operation, and use of Artificial Intelligence-enabled Services.
No oral statements, marketing materials, demonstrations, proposals, presentations, or representations shall modify this Policy unless expressly incorporated into a written agreement executed by Netwindy LLC.
14.9 Reservation of Rights
Nothing contained in this Policy shall be interpreted to limit Netwindy LLC’s rights under the Master Services Agreement (MSA), Terms of Service (TOS), Acceptable Use Policy (AUP), Service Level Agreement (SLA), Privacy Policy, Data Processing Agreement (DPA), or applicable law.
All rights not expressly granted herein are reserved by Netwindy LLC.
14.10 Effective Date
This Responsible Artificial Intelligence (AI) Use Policy becomes effective upon the Customer’s purchase, payment, acceptance, access to, or continued use of any Artificial Intelligence-enabled Service provided by Netwindy LLC and shall remain in effect until superseded by a revised version published by Netwindy LLC or until the applicable Service Agreement is terminated.
